ROME – The position of Novara Calcio, Pro Vercelli 1892 and Ternana must be re-examined by the competent sporting bodies (the latter has already played 5 matches in Serie C). This was decided by the Lazio Regional Administrative Court with three separate precautionary orders, accepting the "application for suspension of all the contested measures, with the consequent obligation for the competent authorities to re-examine them, based on the correct application of the regulatory framework". Merit hearing on March 26th.
The three companies have challenged the decision of the National Court of the FIGC with which the appeals against the resolutions of the Extraordinary Commissioner of the FIGC were declared inadmissible, with which a number of 19 teams was scheduled for the Serie B championship instead of 22, modifying the pre-existing format, with consequent non-integration of the championship staff and therefore the no to repechage.
The TAR considered that "the measures burdened under various aspects show important aspects of dystonia compared to the primary purpose of public interest in the regulation and control of the orderly conduct of the championships and the federal discipline on the subject". And the change in the championships "was taken as part of a commission management" and "the reduction of the team's staff was made in August, a few days before the beginning of the same", without acquiring "the resolution of the other Leagues, which certainly should have been involved, as the determination of the Serie B championship staff affects the interests of the lower league teams interested in being admitted to it ".
In relation to all the arguments made, the TAR considered that "the fumus boni juris existed under the inferred profiles of the excess power and the violation of the statutory provisions of the FIGC system", and that "the continuation of the championship started on the basis of the modalities foreseen in the burdensome measures, appears to the suitable evidence to cause a serious and irreparable damage to the interests of the applicant of entity difficult to quantify, pending the decision of the merit of the appeal, also taking into account the purely initial phase in which, at present, the championship is found ".
The effect is: acceptance of the "application for suspension of all the contested measures, with the consequent obligation for the competent authorities to re-examine them, on the basis of the correct application of the regulatory framework". Merit hearing established March 26, 2019.
The Lega Pro has postponed to a date to be allocated the matches of Pro Vercelli, Novara, Ternana and Siena. The decision was taken following the pronouncement of the TAR of Lazio on the case of repechage in Serie B. The postponed matches are the recoveries of the first day scheduled today Pontedera-Novara, Pro Piacenza-Robur Siena, Pro Vercelli-Piacenza and Ternana-Rimini .
