MILAN – There is room to reach an out-of-court agreement between the former AC Milan Marco Fassone and the Rossoneri club. This is what emerged from the first hearing before the Labor Court of Milan to which the former manager has appealed against his dismissal of last August signed by the new course of the club marked by Elliott and with the presidency of Paolo Scaroni.

The judge Luigi Pazienza, in fact, has decided to postpone the hearing to the next 29 January to verify, as clarified by the lawyers, if, in the meantime, the parties will succeed in establishing a negotiation for an agreement.

At the hearing there was the same ex ad, represented by the lawyer Francesco Rotondi, while Milan was represented by the lawyer Claudio Morpurgo. In the appeal Fassone claimed that it was a "retaliation" dismissal and requested its cancellation. Now the parties, however, will try to find an agreement.

In the appeal Fassone, through his lawyer, he complained about the "retaliation" of the dismissal, explaining that on July 21st the company made him a transaction offer of 2.5 million euros to leave and, from the moment he refused that proposal was fired. Hence the request to the judge to declare the "nullity" of the dismissal which, if accepted, would result in the reinstatement as a manager in the company.

According to the appeal of Fassone, moreover, the same motivation of the dismissal would be illegitimate. In the communication of the dismissal for "just cause", however, Milan had put forward what defined a "serious indifference and negligence with respect to fundamental interests of our company and the resources used in it" by Fassone, managing director in the tormented management company of the mysterious Chinese Yonghong Li (also investigated by the Milan Prosecutor's Office for false accounting), also referring to some "disciplinary dispute letters".

Today after a closed-door hearing, lasting about half an hour, the lawyers of the parties in question have clarified to the reporters that the judge has decided to arrange a postponement for the end of January to see if the 'contenders' will succeed in reaching an agreement for an extrajudicial transaction.
